By accessing and using the services provided by Solix S.A. (Registration Number: 4584569878), located at Avenue Louise 148, 8015 Bruges, Belgium ("Solix", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to these Terms of Service, please do not use our services or website. Your continued use of our services constitutes acceptance of any modifications to these terms.

Description of Services

Solix provides fitness and wellness services including but not limited to:

• Personal training sessions
• Group fitness classes
• Fitness assessments and consultations
• Nutritional guidance and meal planning
• Access to fitness facilities and equipment
• Online fitness resources and support

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

User Obligations

By using our services, you agree to:

• Provide accurate and complete information during registration and maintain updated contact details
• Follow all safety guidelines and instructions provided by Solix staff
• Respect other users, staff, and facility property
• Comply with facility rules and operating hours
• Inform us of any health conditions or injuries that may affect your participation in fitness activities
• Make payments on time according to agreed schedules
• Not share or transfer your membership or access rights to others

Failure to comply with these obligations may result in suspension or termination of your access to our services.

Health and Safety

Your health and safety are our priority. By participating in our services, you acknowledge that:

• Physical exercise involves inherent risks, and you participate at your own risk
• You are responsible for consulting with healthcare professionals before beginning any fitness programme
• You must immediately report any injuries or health concerns to our staff
• You will not participate in activities beyond your physical capabilities
• You will follow all safety protocols and use equipment properly

Solix reserves the right to refuse service or ask you to leave if your behaviour poses a risk to yourself or others.

Payment Terms

Payment terms for our services are as follows:

• All fees are due in advance unless otherwise agreed in writing
• Prices are subject to change with 30 days' notice
• Late payment may result in suspension of services
• Refunds are provided only in accordance with our cancellation policy
• All payments are in Euros unless otherwise specified

Detailed payment and cancellation policies will be provided upon service registration.

Intellectual Property

All content provided by Solix, including but not limited to workout plans, nutritional guides, training materials, website content, logos, and proprietary methodologies, is the intellectual property of Solix S.A. and is protected by copyright and other intellectual property laws.

You may not:

• Reproduce, distribute, or create derivative works from our content without written permission
• Use our trademarks, logos, or branding without authorisation
• Record, photograph, or film our facilities, classes, or training sessions without consent
• Share proprietary training materials or programmes with third parties

Any unauthorised use of our intellectual property may result in legal action and immediate termination of services.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms of Service.

By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and applicable Belgian privacy laws.

Limitation of Liability

To the fullest extent permitted by Belgian law, Solix S.A. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our services
• Any injuries sustained during participation in fitness activities
• Loss or damage to personal property
• Interruptions or delays in service
• Actions or omissions of other users

Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

This limitation of liability does not affect your statutory rights as a consumer under Belgian and European Union law.

Indemnification

You agree to indemnify and hold harmless Solix S.A., its directors, employees, agents, and affiliates from any claims, damages, losses, costs, or expenses arising from:

• Your breach of these Terms of Service
• Your violation of any law or regulation
• Your negligent or wrongful conduct
• Any injury to third parties caused by your actions

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Belgium. The Belgian courts shall have exclusive jurisdiction over any disputes arising from or relating to these terms or your use of our services.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Termination

Either party may terminate the service relationship:

• With 30 days' written notice for ongoing memberships
• Immediately in case of breach of these terms
• Immediately for safety concerns or inappropriate behaviour
• Upon non-payment of fees after reasonable notice

Upon termination, your right to use our services will cease immediately, and any outstanding fees will become due. Certain provisions of these terms will survive termination, including intellectual property rights, limitation of liability, and governing law clauses.

Refunds upon termination will be handled according to our cancellation policy provided at the time of service registration.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to you via email or through prominent notice on our website at least 30 days before the changes take effect.

Your continued use of our services after the effective date of any changes constitutes acceptance of the revised terms. If you do not agree to the changes, you may terminate your service relationship with reasonable notice.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.
